Terms and Conditions

1. Introduction and acceptance
Welcome to Hills Run Club.
These Terms and Conditions apply to:
- Registration with Hills Run Club through HRC+
- Membership of Hills Run Club
- Attendance at or participation in any Hills Run Club run, walk, event, training session, social activity, program, competition or other organised activity
- Use of HRC+ and other services provided by Hills Run Club
- Communications, content and benefits provided in connection with Hills Run Club
By creating an HRC+ account, registering as a participant, booking an activity, attending an activity or otherwise using a Hills Run Club service, you acknowledge that you have read, understood and agreed to these Terms and Conditions.
If you register a participant under 18 years of age, you confirm that you are their parent or legal guardian, that you have authority to accept these Terms and Conditions on their behalf, and that both you and the child agree to comply with them.
If you do not agree to these Terms and Conditions, you must not register for or participate in a Hills Run Club activity.
2. Definitions
In these Terms and Conditions:
Activity means any run, walk, training session, event, program, social gathering, competition, online activity or other activity organised, promoted, supported or associated with Hills Run Club.
Hills Run Club, HRC, we, us and our refer to Hills Run Club Pty Ltd (ABN 49 701 127 059), which operates Hills Run Club, and, where relevant, its founders, officers, organisers, employees, contractors and authorised representatives.
HRC+ means the platform used by Hills Run Club to register participants and manage memberships, bookings, events, participant information, communications and related services.
Organiser includes any person authorised by Hills Run Club to organise, manage, supervise or assist with an Activity.
Participant, member, you and your refer to the person registered through HRC+ and any person attending or participating in an Activity.
Guardian means a parent or legal guardian who has legal responsibility for a participant under 18 years of age.
Volunteer means a person assisting Hills Run Club without necessarily being an employee, professional coach, medical practitioner or qualified event official.
3. Registration and HRC+ accounts
All participants must be properly registered with Hills Run Club through HRC+ before participating in an Activity unless Hills Run Club expressly approves another registration process.
You must:
- Provide accurate, current and complete registration information
- Provide a valid email address and telephone number
- Provide current emergency-contact information
- Update your information if it changes
- Register using your own identity
- Not create a misleading, fraudulent or duplicate account
- Keep your HRC+ login details secure
- Notify Hills Run Club if you believe your account has been accessed without permission
You are responsible for activity conducted through your HRC+ account unless it occurred because of a matter within Hills Run Club's reasonable control.
Registration with Hills Run Club does not guarantee:
- Admission to every Activity
- Availability of places
- Acceptance into a particular pace group
- Access to every HRC+ feature
- Continued membership
- That an Activity will proceed as originally advertised
- That a particular organiser, volunteer, sponsor, venue or service will be available
Hills Run Club may impose capacity limits, age limits, eligibility requirements, registration deadlines, equipment requirements or other reasonable conditions for a particular Activity.
Hills Run Club may refuse, suspend or cancel a registration where information is incomplete, inaccurate or misleading, where payment has not been made when required, or where participation would be unsafe or inconsistent with these Terms and Conditions.
4. Eligibility to participate
You may only participate if you:
- Are correctly registered
- Meet any stated age or eligibility requirement
- Are medically and physically capable of participating
- Have any required equipment
- Are not affected by alcohol or illegal drugs
- Are not impaired by medication or another substance in a way that could make participation unsafe
- Follow these Terms and Conditions and all reasonable directions
- Do not present an unreasonable risk to yourself or another person
Hills Run Club may refuse or stop your participation if an Organiser reasonably considers that you do not meet these requirements.
An Organiser's decision to permit participation is not medical advice and does not transfer responsibility for your health, fitness, preparation or safety to Hills Run Club.
5. Nature of Hills Run Club activities
Unless expressly stated otherwise, Hills Run Club Activities are recreational community activities.
Organisers and Volunteers may have different levels of experience and are not necessarily professional coaches, medical practitioners, traffic controllers, security personnel or qualified first-aid providers.
Information provided about routes, distances, pacing, nutrition, footwear, training or fitness is general information only. It is not medical, health or professional advice and may not be suitable for every person.
You remain responsible for deciding whether an Activity, route, pace, distance or instruction is suitable for you.
6. Participation and assumption of risk
Participation is voluntary and at your own risk.
Running, walking, exercise and participation in public or private spaces involve inherent and sometimes significant risks. These risks may exist even when Hills Run Club and its Organisers take reasonable precautions.
Risks include, but are not limited to:
- Slips, trips and falls
- Collisions with participants, pedestrians, cyclists, vehicles, animals, structures or other objects
- Motor vehicles, roads, driveways, intersections and traffic
- Uneven, wet, loose, steep, unstable, slippery or poorly lit surfaces
- Footpaths, trails, stairs, kerbs, potholes, tree roots, rocks and debris
- Construction work, roadworks and temporary obstructions
- Heat, cold, rain, wind, storms, lightning, smoke, air pollution and reduced visibility
- Dehydration, heat exhaustion, heatstroke and hypothermia
- Fatigue, overexertion, muscle strain and joint injury
- Aggravation of a pre-existing medical condition
- Illness, infection, allergic reaction or medical emergency
- Becoming separated from a group or taking a wrong route
- Limited telephone reception or delayed access to emergency assistance
- Acts or omissions of other participants, members of the public or unrelated third parties
- Serious injury, permanent disability and, in rare circumstances, death
By participating, you acknowledge these risks, voluntarily accept them and agree to take reasonable precautions for your own safety.
7. Medical fitness and health
You confirm that you are medically and physically capable of participating safely.
You are responsible for:
- Considering your health, fitness, experience and limitations
- Obtaining medical advice before participating where appropriate
- Following advice given by your doctor or other qualified health professional
- Informing an Organiser of relevant information where assistance may reasonably be required
- Carrying any medication or medical equipment you need
- Managing allergies, asthma, diabetes and other health conditions
- Maintaining appropriate hydration and nutrition
- Stopping if you experience pain, dizziness, chest discomfort, breathing difficulty, confusion, unusual weakness or another concerning symptom
If you have recently been injured, unwell, undergone surgery, received medical treatment or been advised to restrict exercise, you should obtain appropriate medical clearance before participating.
Hills Run Club does not undertake to assess your medical fitness and is entitled to rely on your confirmation that you are capable of participating.
You must not knowingly participate while suffering from a contagious illness where doing so could unreasonably expose other people.
8. Personal preparation and equipment
You are responsible for arriving appropriately prepared.
Depending on the Activity, this may include:
- Appropriate footwear and clothing
- Sun protection
- Water and nutrition
- Reflective or high-visibility clothing
- A headlamp or other lighting
- Required medication
- A charged mobile telephone
- Identification and emergency-contact information
- Weather-appropriate equipment
You must inspect your own equipment and ensure it is safe and suitable.
Hills Run Club is not responsible for the suitability, condition, failure or misuse of equipment supplied by you or an unrelated third party.
9. Following routes and instructions
Participants must follow all reasonable directions given by Organisers and Volunteers.
Directions may relate to:
- Safety
- Routes
- Pace groups
- Starting and finishing arrangements
- Road crossings
- Behaviour
- Weather
- Emergency procedures
- Venue requirements
- Changes, suspensions or cancellations
You remain responsible for monitoring the route and your surroundings. You must not assume that an Organiser or Volunteer will prevent you from becoming lost, crossing a road unsafely or encountering a hazard.
If you leave the planned route, pace group or Activity early, you should notify an Organiser where reasonably possible.
Hills Run Club may change a route before or during an Activity where reasonably necessary.
10. Roads, traffic and public spaces
Many Activities take place in public areas that remain open to vehicles, cyclists, pedestrians, animals and other users.
Unless an Organiser clearly advises otherwise, you must assume that roads and crossings are open and uncontrolled.
You must:
- Obey applicable road and pedestrian laws
- Use designated crossings where reasonably available
- Check for traffic before entering or crossing a road
- Follow traffic lights and crossing signals
- Avoid obstructing roads, paths, entrances and other public areas
- Show reasonable consideration to other users
- Follow venue, park and council requirements
Being part of a group does not give you priority over traffic or other members of the public.
11. Participants under 18 years of age
A participant under 18 may only participate if:
- The child is registered through HRC+
- Their Guardian is separately registered through HRC+
- The Guardian has accepted these Terms and Conditions for themselves and on behalf of the child
- The Guardian is present for the entire Activity
- The Guardian actively supervises the child
- Any additional age or Activity-specific requirements are satisfied
A child must not be dropped off, left unsupervised or collected after an Activity without their registered Guardian being present, unless Hills Run Club has given express prior written approval for a different arrangement.
Organisers and Volunteers do not act as babysitters, carers or guardians and do not assume parental responsibility for a child.
The Guardian is responsible for:
- Determining whether the Activity is suitable for the child
- Considering the child's health, ability, maturity and experience
- Ensuring that the child is medically and physically capable of participating
- Providing any medication, equipment, food, water and clothing required
- Supervising the child before, during and after the Activity
- Keeping the child within a safe and appropriate distance
- Ensuring that the child follows the route, rules and instructions
- Responding if the child becomes distressed, injured, unwell or separated from the group
- Accompanying the child if the child stops participating
- The child's behaviour and any loss or damage caused by that behaviour, to the extent permitted by law
- Ensuring that emergency-contact information remains current
Children must follow the same safety requirements, behavioural standards and Code of Conduct as adult participants.
Hills Run Club may refuse, suspend or revoke a child's participation where:
- Their Guardian is absent
- Supervision is inadequate
- The child or Guardian fails to follow reasonable directions
- Required registration information has not been provided
- The child's conduct is unsafe, disruptive or inappropriate
- The Activity is unsuitable for the child
- Continued participation may create an unreasonable risk
The Guardian acknowledges the inherent risks associated with the child's participation and, to the maximum extent permitted by law, accepts responsibility for the child's supervision, conduct and welfare during the Activity.
Nothing in this section excludes, restricts or modifies a right or liability that cannot lawfully be excluded, restricted or modified.
12. Code of Conduct
All participants must help maintain a safe, welcoming, inclusive and respectful community.
Participants must:
- Treat participants, children, Guardians, Organisers, Volunteers, sponsors, venue staff and members of the public respectfully
- Follow reasonable instructions
- Use appropriate language
- Respect personal boundaries
- Avoid conduct that places another person at unreasonable risk
- Respect public and private property
- Dispose of rubbish appropriately
- Comply with applicable laws and venue rules
- Avoid deliberately disrupting an Activity
- Act honestly when registering, booking or communicating with Hills Run Club
Participants must not engage in:
- Harassment, bullying, intimidation or stalking
- Discrimination or vilification
- Threatening, violent or abusive behaviour
- Unwanted sexual conduct or comments
- Deliberate physical interference
- Dangerous or reckless conduct
- Fraud, impersonation or misuse of another person's account
- Unauthorised commercial promotion or solicitation
- Conduct reasonably likely to damage Hills Run Club's community or place another person at risk
Hills Run Club may investigate reported conduct and take action it reasonably considers appropriate. This may include a warning, removal from an Activity, temporary suspension or permanent cancellation of registration.
Where reasonably necessary for safety, Hills Run Club may act immediately and without providing advance notice.
13. Emergency assistance and incidents
If Hills Run Club reasonably believes that you require assistance, you authorise Organisers and Volunteers to:
- Contact your emergency contact
- Contact emergency services
- Provide reasonable assistance within their abilities
- Share relevant information with emergency responders
- Arrange transport or medical attention where reasonably necessary
Hills Run Club cannot guarantee that first aid, medical personnel, emergency equipment or emergency services will be immediately available.
You remain responsible for ambulance, hospital, medical, transport and related costs incurred on your behalf, except where applicable law provides otherwise.
You should promptly report accidents, injuries, hazards and serious behavioural incidents to an Organiser.
Reporting an incident does not mean Hills Run Club admits fault or liability.
14. Alcohol, drugs and unsafe impairment
You must not participate while affected by alcohol, illegal drugs, medication or another substance to an extent that may impair your judgment, coordination or ability to participate safely.
Hills Run Club may prevent or stop a person from participating where an Organiser reasonably believes that the person is impaired or presents a safety risk.
15. Photography, video and media
Photography, video and audio recordings may be captured during Activities.
Subject to applicable law, Hills Run Club may use recordings captured by or on behalf of Hills Run Club for:
- HRC+
- Websites
- Social-media channels
- Advertising
- Marketing
- Promotional material
- Event recaps
- Newsletters
- Sponsor and partner communications
- Community and historical purposes
You acknowledge that you will not ordinarily receive payment or other compensation for authorised use of this material.
If you do not wish to be photographed or recorded, you should notify an Organiser before the Activity begins. Hills Run Club will take reasonable steps to respect the request but cannot guarantee that you will not appear incidentally in wide-angle, crowd or background footage.
Hills Run Club cannot control photographs or recordings independently captured by spectators, participants, media organisations or other third parties.
A Guardian must provide any consent required for identifiable images or recordings of a child. A Guardian who does not consent should notify Hills Run Club before each Activity and actively assist the child in avoiding designated photography areas.
16. Marketing communications
Hills Run Club may send operational communications reasonably necessary to manage your registration, account, membership or participation. These may include:
- Booking confirmations
- Event reminders
- Route information
- Safety instructions
- Weather notices
- Changes and cancellations
- Account and security messages
- Emergency communications
- Important service or policy updates
Operational communications are separate from marketing consent.
If you separately and voluntarily opt in to marketing, you consent to Hills Run Club contacting you using information you provide through HRC+ or another Hills Run Club form.
Marketing communications may be delivered through:
- SMS or text message
- Telephone calls
- Voicemail
- Messaging applications, including WhatsApp
- Push notifications
- HRC+ notifications
- Social-media direct messages
- Postal mail where an address has been provided
- Other communication channels you expressly agree to use
Marketing may relate to:
- Hills Run Club news
- Runs, events and activities
- Memberships and HRC+ services
- Merchandise
- Promotions and competitions
- Surveys and feedback opportunities
- Community announcements
- Sponsor or partner offers
- Products, services and opportunities Hills Run Club reasonably believes may interest members
Marketing consent is optional. Refusing marketing consent will not by itself prevent registration or participation.
You may withdraw marketing consent at any time by:
- Selecting the unsubscribe link in an email
- Replying STOP to an SMS where instructed
- Asking the caller to stop during a telephone call
- Changing your HRC+ communication preferences where available
- Contacting admin@hillsrunclub.com
Hills Run Club will process opt-out requests as required by applicable law. Withdrawal of marketing consent does not prevent Hills Run Club from sending necessary operational, transactional, account, legal or safety communications.
Marketing communications will identify Hills Run Club or the authorised sender and provide an appropriate way to opt out where required.
17. Personal information and privacy
Hills Run Club may collect, use, store and disclose personal information provided through HRC+ or otherwise supplied in connection with registration and participation.
Information may include:
- Name
- Date of birth
- Contact information
- Emergency-contact details
- Registration and attendance information
- Communication preferences
- Relevant health or accessibility information voluntarily provided
- Incident information
- Photographs or recordings
- Records of communications with Hills Run Club
This information may be used to:
- Create and manage HRC+ accounts
- Administer memberships and Activities
- Confirm eligibility
- Communicate operational and safety information
- Respond to enquiries
- Manage incidents and emergencies
- Maintain attendance and administrative records
- Improve Hills Run Club services
- Prevent misuse and protect participants
- Send marketing where valid consent exists
- Comply with legal obligations
Information may be disclosed where reasonably necessary to service providers, emergency personnel, venues, insurers, professional advisers, government authorities or other parties authorised or required by law.
Personal information will be handled in accordance with Hills Run Club's Privacy Policy and applicable privacy requirements.
18. Weather, postponements and changes
Hills Run Club may postpone, cancel, relocate, shorten, suspend or otherwise modify an Activity because of:
- Heat, rain, storms, lightning, smoke or poor air quality
- Flooding or fire danger
- Unsafe surfaces or route conditions
- Traffic or road closures
- Venue unavailability
- Government or emergency-service directions
- Insufficient attendance
- Organiser or Volunteer availability
- Equipment or technology failure
- Public-health concerns
- Other safety, operational or external circumstances
Changes may occur before or during an Activity.
Participants are responsible for checking HRC+, email, social media or other designated communication channels before attending.
Hills Run Club does not guarantee that every communication will be received before an Activity begins.
Any refund or credit entitlement for a paid Activity will be determined by the applicable booking conditions and rights that cannot legally be excluded.
19. Fees, bookings and refunds
Where an Activity or service requires payment:
- Fees must be paid using an accepted payment method
- Your booking may not be confirmed until payment is received
- Additional Activity-specific terms may apply
- You are responsible for reviewing booking details before completing payment
- Refunds, credits and transfers will be governed by the applicable booking conditions and Australian Consumer Law
Hills Run Club may correct an obvious pricing or administrative error. If this materially affects a confirmed booking, Hills Run Club will provide any remedy required by law.
Nothing in these Terms and Conditions excludes rights that cannot be excluded under Australian Consumer Law.
20. Personal property
Participants are responsible for their belongings before, during and after an Activity.
You should not leave valuable or essential property unattended.
To the maximum extent permitted by law, Hills Run Club is not responsible for property that is lost, misplaced, stolen or damaged during an Activity.
Hills Run Club does not undertake to provide secure storage.
21. Loss or damage caused by participants
You are responsible for loss or damage caused by your deliberate, unlawful, reckless or negligent conduct, to the extent permitted by law.
You may be required to pay the reasonable cost of repairing or replacing property you damage where you are legally responsible for that damage.
For a participant under 18, their Guardian is responsible for supervising the child and accepts responsibility for the child's conduct to the extent permitted by law.
22. Liability and release
You acknowledge that participation in recreational running and related Activities carries inherent risks, including risks that may arise despite reasonable safety precautions.
To the maximum extent permitted by law, you release and hold harmless Hills Run Club and its founders, officers, Organisers, employees, contractors, Volunteers, sponsors and partners from claims, losses, costs, damages and expenses arising from or connected with your participation.
Without limiting any right that cannot lawfully be excluded, Hills Run Club does not accept responsibility for injury, loss or damage caused by:
- Your failure to follow instructions or these Terms and Conditions
- Your medical condition or lack of preparation
- Your choice of route, pace, distance or equipment
- Your failure to carry necessary water, medication or equipment
- The conduct of another participant or unrelated third party
- An inherent or obvious risk of an Activity
- Roads, traffic, weather, surfaces or public-space conditions
- Circumstances outside Hills Run Club's reasonable control
Nothing in these Terms and Conditions excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
23. Personal insurance
Hills Run Club recommends that participants consider maintaining appropriate:
- Private health insurance
- Ambulance cover
- Personal accident insurance
- Travel insurance where relevant
- Income-protection insurance
Hills Run Club does not represent that its own insurance will cover every participant, incident, injury, loss or claim.
24. Sponsors, partners and third parties
Hills Run Club may work with sponsors, venues, service providers and community partners.
Unless Hills Run Club expressly states otherwise:
- A third party is responsible for its own products, services and conduct
- Hills Run Club does not guarantee a third-party product or service
- A sponsor relationship is not necessarily an endorsement of every product or statement made by that sponsor
- Separate third-party terms may apply
- Disputes concerning a third-party transaction may need to be addressed directly with that third party
Nothing in this section limits rights that cannot lawfully be excluded.
25. Intellectual property
The Hills Run Club and HRC+ names, logos, branding, photographs, videos, graphics, written material, website content, event material and other content are owned by or licensed to Hills Run Club unless stated otherwise.
You must not reproduce, modify, distribute, sell, commercially exploit or represent yourself as authorised to use Hills Run Club intellectual property without prior written permission, except where permitted by law.
Participants may share official Hills Run Club social-media posts using the sharing tools provided, provided the material is not altered or used misleadingly.
26. Suspension, cancellation and removal
Hills Run Club may refuse, suspend or cancel a person's registration, booking, membership or participation where reasonably necessary because of:
- A safety concern
- Serious or repeated misconduct
- Harassment, abuse or threatening behaviour
- Failure to supervise a child
- Failure to follow reasonable instructions
- Fraudulent or misleading information
- Misuse of HRC+
- Non-payment of applicable fees
- A material breach of these Terms and Conditions
- Conduct reasonably likely to harm another person or Hills Run Club's community
Depending on the seriousness of the circumstances, Hills Run Club may provide a warning or opportunity to respond. Immediate action may be taken where reasonably necessary to protect safety or prevent harm.
Any refund entitlement following suspension or cancellation will be determined by applicable booking terms and rights that cannot legally be excluded.
27. Complaints and concerns
Safety concerns, misconduct reports and complaints should be sent to admin@hillsrunclub.com.
You should provide sufficient information for Hills Run Club to understand and assess the matter.
Hills Run Club may request further information and may need to speak with other people involved.
Hills Run Club will determine an appropriate response based on the information reasonably available. It does not guarantee a particular outcome or that all information can remain confidential.
28. Changes to these Terms and Conditions
Hills Run Club may update these Terms and Conditions where reasonably necessary, including to reflect changes to:
- Activities and services
- HRC+
- Safety requirements
- Membership arrangements
- Communication practices
- Operational requirements
- Applicable laws and regulatory guidance
The current version will be published on the Hills Run Club website or made available through HRC+. The "Last updated" date will identify the latest revision.
Where a change materially affects participants' rights or obligations, Hills Run Club will take reasonable steps to provide advance notice where practicable.
Continued registration, use of HRC+ or participation after updated Terms and Conditions take effect constitutes acceptance of the updated Terms and Conditions.
If you do not agree to a material change, you may stop participating and contact Hills Run Club regarding your registration.
A change will not operate retrospectively where doing so would be unlawful or unfair.
29. Additional Activity terms
A particular Activity may have additional rules, safety instructions, booking conditions or eligibility requirements.
Those additional conditions form part of these Terms and Conditions once they are communicated to you.
If an Activity-specific condition conflicts with these general Terms and Conditions, the Activity-specific condition will apply to that Activity to the extent of the inconsistency, except where doing so would be unlawful.
30. No waiver
If Hills Run Club does not immediately enforce a provision of these Terms and Conditions, that does not mean it has waived the provision or cannot enforce it later.
A waiver is only effective if Hills Run Club confirms it in writing.
31. Severability
If a provision is found to be invalid, unlawful or unenforceable, it will be read down to the minimum extent necessary to make it valid and enforceable.
If it cannot be read down, that provision will be severed. The remaining provisions will continue to apply.
32. Entire agreement
These Terms and Conditions, any applicable Activity-specific conditions and Hills Run Club's Privacy Policy contain the terms governing registration and participation.
Nothing in this section excludes responsibility for misleading or deceptive conduct or another responsibility that cannot legally be excluded.
33. Governing law
These Terms and Conditions are governed by the laws of New South Wales, Australia.
You submit to the jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.

Participant agreement
By registering through HRC+, attending an Activity or otherwise participating in Hills Run Club, you confirm that:
- You have read and understood these Terms and Conditions
- You agree to comply with them
- You understand the inherent risks of participation
- You accept personal responsibility for participating safely
- The information you have provided is accurate
- You understand that rights that cannot legally be excluded continue to apply
For a participant under 18, their Guardian additionally confirms that:
- They have authority to register the child
- They accept these Terms and Conditions for themselves and on behalf of the child
- They will be present and actively supervise the child throughout every Activity
- They accept the responsibilities set out in the section concerning participants under 18
